Who regulates the FDA?
That is determined by Congress in establishing the FDA's authorities. Even when FDA approval is not required before a product is sold, the agency has legal regulatory authority to act when safety issues arise.
The FDA is led by the Commissioner of Food and Drugs, appointed by the President with the advice and consent of the Senate. The Commissioner reports to the Secretary of Health and Human Services. Robert Califf is the current commissioner, as of 17 February 2022.
Congressional Oversight
The FDA interacts with the Congress in many ways. It deals with two legislative committees: the House Committee on Energy and Commerce, and its Subcommittee on Health and the Environment, and the Senate Committee on Labor, Health, and Human Resources, and its Subcommittee on Health.

FDA develops regulations based on the laws set forth in the Food, Drug, and Cosmetic Act (FD&C Act) or other laws – including the Family Smoking Prevention and Tobacco Control Act – under which FDA operates. FDA regulations have the full force of law.
The FDA Office of the Ombudsman is the Agency's focal point for addressing complaints and assisting in resolving disputes between companies or individuals and FDA offices concerning fair and even-handed application of FDA policy and procedures.
Aside from overseeing the meat, poultry, eggs, and produce, the USDA also handles the agencies responsible for US dietary guidelines and Supplemental Nutrition Assistance Program (SNAP) benefits. Meanwhile, the FDA regulates the nutrition facts labels on all processed food.
Since 1879, nearly 100 bills had been introduced in Congress to regulate food and drugs; on 30 June 1906 President Roosevelt signed the Food and Drugs Act, known simply as the Wiley Act, a pillar of the Progressive era.

Consumers can play an important public health role by reporting to FDA any adverse reactions or other problems with products the agency regulates. FDA is responsible for ensuring that foods are safe, wholesome, and correctly labeled.

An Overview. The USDA oversees over meat, poultry, and egg products. However, the majority of the food supply (80% or more) is regulated by FDA. FDA is responsible for dairy, seafood, produce, packaged foods, bottled water, and whole eggs.
Background. Historically, catfish food safety inspection fell under the responsibility of the FDA (along with all other seafood) until Congress, in the 2008 Farm Bill, directed USDA to develop an inspection process and regulate catfish processing.
The USDA regulates the production of meat, poultry and egg products. USDA-regulated businesses are required to have a USDA inspector onsite at all times. The FDA regulates the production of everything else (non-meat foods, unusual meats, and fish products).
Allegations that unsafe drugs are approved
Some critics believe that the FDA has been apt to overlook safety concerns in approving new drugs, and is slow to withdraw approved drugs once evidence shows them to be unsafe.
FDA also plays a significant role in the Nation's counterterrorism capability. FDA fulfills this responsibility by ensuring the security of the food supply and by fostering development of medical products to respond to deliberate and naturally emerging public health threats.

What FDA does not regulate?
The FDA does not regulate the practice of medicine, medical services, the price or availability of medical products and whether they are reimbursed by health insurance or Medicare.
